To use the Site, you must (1) be at least 18 years of age or if you are under 18 years of age, you must have permission from your parents or legal guardian to use our Service and (2) have the power to form a binding contract with us and are not prohibited from doing so under the applicable law. In using the Site, you agree that any information you submit is correct and accurate.

The Site provides its Service by offering a mobile system for learning English, select online video coaching sessions with our trained coaches and access to a mobile ecosystem for tracking your progress.

The Site may change the terms of use at any time without notice to you by making such changes on the Site. You acknowledge that your agreement to the terms of use and your use of the Site constitute your agreement to be bound by such agreements.

Certain conditions have to be in place in order to run steady video coaching sessions with our trained coaches, including:

1. Installation of the latest Chrome or Firefox browser and its extension;

2. Opentok extension for Chrome or Firefox installed;

3. Minimum dedicated 512kbps internet connection;

4. The Site provides Session Simulator, an exclusive tool that you could use to simulate a video session. Running this step is mandatory in order to determine how your video session will work. This step shall be executed in the environment where the booked video session will take place. In a case where the environment does not deliver sufficient support, you may request to reschedule a session. We are not responsible for any connection disturbance during an ongoing session.

nexgen english online co. owns all rights to all code, data and materials, design, including but not limited to any copyrights, patent rights, database rights and other intellectual property and proprietary rights therein. Content is licensed from the content developer.

Your use of the Site does not grant you ownership of any content, code, data or materials you may access on the Site. Any distribution, publishing or exploitation of the Site or any content, code, data or materials on the Site is strictly prohibited unless you have received prior permission.

You may not copy, reproduce, distribute or exploit any content, code, data or materials of the Site. By copying, reproducing, distributing or exploiting any content, code, data or materials of the Site, you may violate copyright and applicable laws of the United States of America and may be subject to liability for such unauthorized use.

In order to obtain access to the Site, you must register to use the Service of our portal. To access more of our products and services, the Site will require you to pay certain fees.

The fee that you are charged will gain you full access to use our products and services. Nonetheless, you shall abide by the terms set out in clause 3 above.

Upon registration and payment, the Site will send you a confirmation included as a proclamation that you are the owner of the account (the “neo Student Account”). You will be asked to provide your personal information and data (the “Personal Information”) as part of the process.

Each of our trained coaches owns a personalized and individualized account (the “neo Coach Account”). You may select your personal coach for each session. Each neo Student Account and neo Coach Account refers to an account (the “Account”) registered to the Site.

By obtaining a neo Student Account through the registration and payment process, you also secure a number of tokens that you need to settle video coaching sessions with our trained coaches. You may get a refund for your tokens if your selected coach enters the classroom 5 minutes late. As stated in clause 2, running the tool that simulates how your video session will work is mandatory in order to secure your video session. In an event where you neglect this step and the video session is unsatisfactory, you will not receive a refund. In that case, the Site will not be responsible or liable for loss or damage.

You are responsible for the confidentiality of your Account. Each Account must be used individually and is not transferable. Should there be any unauthorized use of your Account, immediately notify the Site. The Site will not be responsible or liable for any loss or damage arising from your failure to comply with this provision.

Your Personal Information is subject to our Privacy Policy which is incorporated herein by reference for all purposes. You acknowledge and agree that you are solely responsible for the accuracy and content of your Personal Information. By purchasing a Student Account, registering and using the Service, you accept the terms of service and you also indicate that you understand, agree and consent to the collection and use of Personal Information.

By using our Service, you agree to use it in a diligent, proper and lawful manner. You may not violate any applicable local, state, national or international law.

The Site does not condone any offensive, inappropriate or repulsive behavior. The Site has the tools and the right to record and audit any act within the Site in order to ensure users are only exposed to a healthy and safe environment at all times and to prevent any violation by and/or to any party active on the Site. This includes the tools and right to access your Personal Information, observe any of your actions within the Site while using the Service. The Site has the right to randomly monitor activities of the users. In a case where a violation is suspected or reported, further inspection shall be made. Immediately notify the Site if you detect a violation.

The Site keeps your Personal Information and Account confidential. You acknowledge and agree that the Site may preserve Personal Information and that the Account and may disclose your Personal and Account Information if required to do so by law or in the good belief that such preservation or disclosure is reasonably necessary to (1) comply with a legal process, (B) enforce the terms of service, (C) respond to claims of a violation or (D) protect the rights, property, or safety of the Site, its users and the public.

You acknowledge and agree that the Site reserves the right at its sole discretion at any time to temporarily or permanently discontinue the Service. The Site may terminate your Account, limit your access to or suspend your Account without prior notice. Cause for such termination, limitation or suspension of access shall include but not be limited to: (1) a breach or violation of the Terms of Service, (2) engagement by you in illegal activities and (3) nonpayment of the fee in connection with the Service.

Upon termination of your Account, you may lose all access to the Service and any portion thereof. Any individual components of the Service that you may have used will also be terminated in accordance with the license agreement of the courseware.

You agree that all terminations, limitations and suspensions of access shall be made at the Site’s sole discretion and that the Site shall not be liable to you or any party involved.
